What a customs broker does

A customs broker deals with the customs authority on behalf of the importer or exporter. In the United States that authority is U.S. Customs and Border Protection; in Mexico it is the tax and customs administration. The work is documentary and regulatory rather than physical:

Customs brokers are regulated. In the United States a broker must hold a permit from CBP, and in Mexico the customs agent is authorised under Mexican customs law. This is the part of the job where an error becomes a penalty, a seizure or a retroactive duty bill, so experience matters more than price.

What a freight forwarder does

A freight forwarder organises the transport. The forwarder does not usually own the trucks, vessels or aircraft; it books capacity, consolidates freight, issues transport documents and manages the shipment from origin to destination:

Can one company be both?

Yes. The two functions are regulated separately, so a company can hold the customs authority and the transportation authority and perform both. Eilan does both for shipments between the United States and Mexico.

Do I need a broker for a small shipment?

Commercial shipments still have to be entered correctly, whatever the value. Small shipments are often where classification and valuation mistakes start, and those mistakes follow the importer.

Who is responsible if the entry is wrong?

The importer of record carries the legal responsibility for the accuracy of the entry. That is why the broker you choose, and the quality of the information you give them, matters.
